TOPIC: Question about a simulator question on Ethics

One of the practice exam questions is confusing me.

I cannot cut and paste from the simulator but it goes something like this:

Well, I am all for ethical behaviour, but the delivery was rejected for good cause. Nothing was delivered. They might as well have delivered bags of bird seed rather than "A" frames.

1) How is it unethical to hold back the payments?
2) Could this question really be on the PMP exam?
